Terms of Service

This is SORROWSHOWERS’ Terms of Service (“TOS”), which is applicable to ALL sales facilitated by SORROWSHOWERS. For questions, comments, and/or concerns, email ajax.freyr@gmail.com.

Condensed TOS

The condensed TOS is provided solely for the buyer to have an easier to read version of the TOS. Please refer to the full TOS outlined below for more detailed terms, as it WILL apply to ALL sales.

• All payments must be delivered in USD, via Venmo, Paypal, or Zelle.
• Customers must pay half upfront and half before delivery, unless the order is under $15 USD, which will be paid all upfront.
• A full or partial refund can be requested if progress on the final product has stagnated for 1 week, or after 1 month without a completed product.
• The artist has the right to refuse any request for any reason, stated or not. Refusal of requests can, in some circumstances, be bypassed by paying a flat $200 USD (see: “dignity fee” in the VIII: Other section).
• The final product is licensed only for personal use. Customers seeking out a commercial usage license can work out an agreement with the seller, or pay a flat $500 USD (see: “exclusivity/NDA fee” in the VIII: Other section, and the Personal and Commercial Use section).
• The final product CANNOT, under ANY circumstance, be used for blockchain nor generative AI related technologies.

Full TOS

This contract applies to:

• The artist, Ajax Freyr/SORROWSHOWERS, further called Artist,
• The buyer, a person or institution, further called Customer,
• And the artistic product produced by Artist, further called Product.

By ordering Product from Artist, the Customer agrees to the following terms and conditions:

I: Payment

• Invoices will be delivered via a casual message (ex: “Your total is COST, and will be paid using PAYMENT METHOD.”). Customers requiring an official invoice will communicate beforehand with the Artist.
• On orders over $15 USD, the Customer must pay half the invoice total upfront (before the artistic process commences), and half the invoice before Product delivery. On orders below $15 USD, the Customer will pay the full invoice total upfront.
• Any other payment schedule must be agreed upon before work on Product commences.
• Customers accept that work will not begin on Product until payment has been received by the Artist according to the above/agreed upon schedule.

II: Currency

• Customers agree to pay the full amount in United States Dollars (USD).
• It is the sole responsibility of the Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees, and other costs involved in transferring funds to the Artist.
• Payment is considered as received and completed only when the total amount of currency received is equal to invoice amount in USD.
• Payment will be conducted through the following services: Paypal, Venmo, or Zelle.

III: Refunds

• Customers have the right to request a refund when there has been more than 1 week without progress on the Product, OR when the Product has not been completed in 1 month.
• Above provisions exclude interruptions caused by unforeseen circumstances such as illness, accident, or any other credible, documented reason for interruption of work.
• Customers must respond to requests, opinions, clarifications, etcetera. by Artist in a swift manner (~24 hours). Lack of response will be recognized as implicit approval of all work progress and current state of Product.

IV: Cancellations

• Artist reserves the right to cancel any order without giving reasons to Customer.
• If an order is cancelled, Customers will receive a full or half refund depending on the amount of work completed.
• Any disrespectful behavior will not be tolerated, and will result in cancellation. The Artist will have the full right to refuse any service to the Customer in the future.

V: Usage

• By default, the Product received by the Customer is for personal usage. Simply, the Customer must not financially profit off of the Product in any way.
• Customers seeking out commercial usage licenses must communicate with Artist beforehand to sign a separate agreement defining the exact conditions and financial implications of such use of the Product. The Customer can also request TOTAL ownership of the Product by applying an “exclusivity/NDA fee” outlined in the “VIII: Other” section below.
• Customer does NOT, under ANY circumstance, hold the right to use the Product in any blockchain or AI-related industries, including any further inventions in the spaces.

VI: Product Delivery

• Customer agrees that the Product will be delivered digitally to an email address provided by the Customer, after the final payment has been received by Artist.
• Any other method of delivery, digital or physical, must be mutually agreed on before the work commences. Customers are obligated to bear any costs incurred by alternative delivery methods, such as postal costs, material costs, digital service subscription fees, etcetera.
• The Artist cannot be held accountable for Customer’s loss of access to the product, such as losing the original file(s) or being impeded by spam filters. The Artist cannot guarantee that the original copy of the product will be available after the last communication between the Artist and Customer.

VII: Revisions

• Customers have the right to 4 rounds of revisions/critique during the initial and sketch phases of the Product.
• Customers have the right to a reasonable amount of minor edits after completion, such as changing the eye color of a character or repositioning a small accessory.
• Bigger edits, such as changing the piece’s color palette or posing of a character, requires an additional payment of $5 USD for each large edit. Work on such requests will not commence until the payment for the additional invoice(s) has been received.

VIII: Other

• A “dignity fee” of $200 USD will be applied to orders that depict the following subjects (although this list is not exhaustive): Sexual violence such as incest, rape, and physically violent sexual encounters, AND/OR any sexual fetishes in the realm of vore and inflation.
• An “exclusivity/NDA fee” of $500 USD will be applied to orders where the Customer requests FULL ownership of the product, or paying for the Artist’s silence regarding the Product and the Customer (EXCEPT any allegations of abuse caused by the Customer).
• Communications between the Artist and Customer must be conducted over email, Instagram, or Discord.
• If the Customer breaks the TOS in an exploitative manner (such as filing a fraudulent refund or being excessively aggressive), the Artist reserves the right to warn others online and/or in person about the Customer.
